Swim Meet Photography Reservation Agreement

This Photography Reservation Agreement ("Agreement") is entered into between DALE FOTO ("Photographer") and the client ("Client") for the purpose of photographing events at swim meets. By making a reservation, the Client agrees to the following terms and conditions:

1.1. Reservation Confirmation: A reservation is confirmed once the Client completes the reservation form and full payment is received.
1.2. Reservation Fee: The reservation fee covers the time and effort spent photographing and editing images of the Client’s swimmer(s). This fee is non-refundable except as specified in Section 6.

2.1. Photographic Coverage: The Photographer will photograph the swimmer(s) during the swim events specified in the reservation.
2.2. Fist come First Serve: Reservations are taken on a first come, first served basis, with one slot available per heat.

2.3. Limited Coverage Disclaimer: While every effort will be made to cover all reserved events, circumstances such as multiple swimmers in different lanes or heats may limit coverage.

3.1. Private Gallery: The Client will receive access to a private gallery containing the photos taken of their swimmer(s).
3.2. Digital Products: Photos will be delivered as high-resolution digital files. No physical prints are provided unless otherwise specified.

4.1. Personal Use License: The Client is granted a non-exclusive, royalty-free license to download, print, and share the images for personal use. Commercial use of the images is prohibited without written permission from the Photographer.

5.1. Consent: By making a reservation, the Client grants permission for the Photographer to take and deliver photos of the swimmer(s) named in the reservation form.
5.2. Privacy Protection: Only those with the gallery password will have access to the photos.

6.1. Missed Events: If the Photographer misses an event and no comparable coverage is available, the reservation fee for that event will be refunded.
6.2. Poor Coverage: If the Client is dissatisfied with the photos due to inadequate coverage, the Client may request a refund or credit for future reservations.

6.3. Transaction fees for Venmo and Credit Card transactions will be deducted from any refund if applicable.

7.1. No Guarantee of Specific Shots: While the Photographer will make every effort to capture high-quality photos, no guarantees are made regarding specific poses, angles, or number of photos.
7.2. Force Majeure: The Photographer is not liable for delays or failure to perform due to circumstances beyond their control (e.g., weather, technical issues, or venue restrictions).

8.1. Reservation Changes: Changes to the reservation must be made before the meet start time.
8.2. Cancellations: Cancellations made by the Client are subject to the non-refundable reservation fee.
